The joys of tax season coupled with some snow in the Northeast has really kicked March off with a bang. In an interesting move, the IRS has jumped on the aggressive employee vs. independent contractor bandwagon by expanding its voluntary classification settlement program. The states have been on a tirade in this area for the last few years, and now the Feds are expanding this program to encourage worker re-classification. Seems like a bit of hard ball “collusion” between the Fiefdoms and the Federal government if you ask me. The times, they really are a changing. Have a great month, and enjoy March Madness. IRS Expands Voluntary Classification Settlement Program The IRS has expanded its Voluntary Classification Settlement Program (VCSP), which allows taxpayers to achieve legal certainty by reclassifying their workers as employees for future tax periods. Several eligibility requirements have been changed to allow more employers, particularly larger ones, to apply for the VCSP. The program, which provides partial relief from federal payroll taxes for eligible employers who are treating their workers, or a class or group of workers, as independent contractors and want to treat them as employees. Businesses, tax-exempt organizations, and government entities can apply to participate in the VCSP by filing Form 8952, Application for Voluntary Classification Settlement Program, at least 60 days before they want to begin treating the workers as employees. Under the program as expanded, employers under IRS audit (other than an employment tax audit) can qualify for the VCSP. In addition, employers allowed into the program will no longer be subject to the “special” six-year statute of limitations. Further, until June 30, 2013, the IRS is waiving the eligibility requirement that an employer must file Forms 1099 with respect to workers they are seeking to reclassify for the past three years. Once again the Supreme Court of our fine nation shows that they don’t have the temerity to even hear a case regarding state taxes, as the Court has denied certiorari in the controversial click through nexus sales tax case. So in effect, the click through nexus or “Amazon” law now becomes the law of the land, as any state can now adopt it without fear of it being overturned by the Court. Now it’s too bad the US Supreme Court didn’t act like the Illinois Supreme Court who recently properly held this same law unconstitutional. Unfortunately, now that the Federal threat has been removed, the door is now wide open for a substantial amount of new jurisdictions to enact this ridiculous legislation. Well at least sanity remains in the Land of Lincoln. Enjoy the rest of your December and the rest of the holiday season. Arizona – Corporate Income Tax – Gain from Sale of Subsidiary Was Business Income The Arizona Court of Appeals recently held that a taxpayer’s gains from the sale of a wholly-owned subsidiary, with which it was engaged in a unitary business, were apportionable business income for Arizona corporate income tax purposes, despite the taxpayer’s election to treat the sale as a deemed asset sale under IRC §338(h)(10). The Court held that under the functional test for determining whether gain from a transaction is business income, income arising from property constitutes business income if the control and use of the property are closely related to the taxpayer’s regular trade or business. Prior to sale, the subsidiary’s assets were used to produce business income for the taxpayer. Also, in previous years, the taxpayer reported the income that the subsidiary produced as business income on its combined corporate income tax return. First Data Corp. v. Arizona Department of […]

I won’t get into my thoughts on our elected “leaders,” but they did come up with something that will raise some revenue, but very little happened on the expense side of the ledger. Things that make you go hmmm. It will be interesting to see how the next few rounds of this melodrama play out. Stay tuned. I hope you all enjoyed the holidays. Have a great January. The Fiscal Cliff Bill is dubbed the American Taxpayer Relief Act of 2012 (H.R. 8). Please find a summary of the major provisions below: INCOME TAXES Permanently extend most of the individual income tax relief provided in the Economic Growth and Tax Relief Reconciliation Act of 2001 (EGTRRA) and the Jobs and Growth Tax Relief Reconciliation Act of 2003 (JGTRRA) for unmarried taxpayers with income of $400,000 or less and married taxpayers with income of $450,000 or less. Permanently set the top marginal tax rate at 39.6 percent (up from 35 percent in 2012) for unmarried taxpayers with income over $400,000 and married taxpayers with income over $450,000. Permanently set the top rate on income from capital gains and qualified dividends at 20 percent (up from 15 percent in 2012) for unmarried taxpayers with income over $400,000 and married taxpayers with income over $450,000. Increase the individual AMT exemption to $50,600 for unmarried filers and $78,750 for married filers for 2012, permanently index those exemption amounts for inflation beginning in 2013, and allow nonrefundable personal credits against the AMT. Permanently reinstate the personal exemption phase-out (PEP) and limitation on itemized deductions (Pease) for single taxpayers with adjusted gross income (AGI) above $250,000 and joint filers with AGI over $300,000, with the thresholds indexed annually […]

Efectivamente la velocidad de carga es muy importante y para conseguir que tu blog cargue más rápido hay que tener en cuenta el hosting, la plantilla, los plugins, el contenido... Yo uso el plugin EWWW Image Optimizer pero sólo en algunos proyectos. Lo que hago siempre es comprimir las imágenes con Photoshop antes de subirlas. Con respecto a AMP hice pruebas hace meses y no me gusta. Creo que vale solo para algunos medios y no para blogs personales. Now, it is quite impressive to see Connecticut step so quickly into the 21st century regarding identity theft. It usually takes the fiefdoms years upon years to catch up on issues like this. Considering all the press regarding identity and tax refund theft, it is great to see a tax department take preventative measures in this area. The real question becomes can they administer this program while causing minimal harm? I’m betting not; Let’s hope I’m wrong. Have a great February. California – Corporate Income Tax – Supreme Court Grants Review in Gillette The California Supreme court recently granted the Franchise Tax Board’s (“FTB”) petition for review of the California Court of Appeal’s decision in The Gillette Company, et al., v. California Franchise Tax Board (“Gillette”). In that decision, the California Court of Appeals upheld the right of the taxpayers to elect to allocate and apportion income to California using the Multistate Tax Compact (the “Compact”) as statutorily adopted in California Revenue and Taxation Code. The election at issue allowed the taxpayers to apply the Compact’s equally-weighted, three-factor apportionment formula (property, payroll and sales), while eliminating the double weighting of the sales factor applicable to most taxpayers. The Gillette Company, et al. v. California Franchise Tax Board, 2013 Cal. LEXIS 282 (Jan. 16, 2013), petition for review granted. Al poco noté como los pedidos continuaban a buen ritmo, pero el precio medio de carrito subía. Recomendé al cliente subir de nuevo los gastos de envío y nuevamente la medía de carrito subió. Y así has dos subidas más en los gastos de envío. Claramente el precio medio por pedido ha subido. De todos modos este "truco", en mi opinión, funciona muy bien para ecommerce con productos con precios bajos como puede ser alimentación, porque si nos vamos a un ecommerce de productos de alta fidelidad con precios de tres cifras mínimo, creo que los gastos de envío gratuitos si que son un elemento diferenciador. California – Corporate Income Tax – Throwback Rules for Sales to Other States and Foreign Jurisdictions Addressed The California Franchise Tax Board (FTB) has issued a chief counsel ruling that addresses the corporation franchise and income tax apportionment formula’s sales factor throwback rules applied to sales made to purchasers located in foreign jurisdictions and other states. The FTB advises a multistate corporation based in California that it should not throw back gross receipts from sales made to purchasers in a foreign jurisdiction for purposes of determining its California sales factor numerator if there were more than $500,000 of sales transacted in the foreign jurisdiction. Similarly, gross receipts from sales of other than tangible personal property to purchasers in other states made by a member of the taxpayer’s combined reporting group would be excluded from the sales factor numerator. Chief Counsel Ruling 2012-03. Kentucky – Amnesty Commenced on October 1st Kentucky’s amnesty program will be held between October 1 and November 30, 2012. Hola Borja, Muchas gracias por tu post, contiene mucha información y hay que guardárselo en favoritos para leerlo con mimo para sacarle el mejor provecho. Yo estoy haciendo un curso de marketing online y todavía no he comenzado con el módulo de SEO. Me parece que esto sera la asignatura hueso ya que tecnológicamente me parece mas avanzado aunque si que es verdad que muchas de las funcionalidades se van adaptando para que los podamos llevar a cabo los que no somos ingenieros informáticos. Cuando me ponga mas en serio con este tema, retomaré el post para sacarle mas partido. Aun así ya he sacado algunas conclusiones muy positivas como la densidad de las palabras clave. Te recomiendo que te centres en conseguir suscriptores ofreciendo algún libro gratis para después ofrecer tus servicios de consultoria o crear libros, cursos, etc. Tienes el tráfico que todo el mundo sueña. Fantástico artículo. Estoy totalmente de acuerdo que el seo cada vez más pasa por el Branding y Social media, no obstante creo que el intercambio de enlaces aún no ha muerto, está muriendo aún así yo almenos, estoy compitiendo en algunos proyectos con sitios web que intercambian enlaces descaradamente y te aseguro que son unos buenos huesos de roer, lógicamente tienen más factores positivos pero todo ayuda. Aún así estoy totalmente de acuerdo que una correcta política de linkbuilding y generación de contenidos es lo suficientemente potente como para no recurrir a estas técnicas penalizadas.

The Service’s response to the recent Supreme Court decision was lightning fast, by IRS standards. In an unrelated note, the New York Amazon law has been appealed to the US Supreme Court, it will be interesting to see if the court has the courage to hear it. Further, Connecticut commences it Tax Amnesty on September 16. 2013. Keep an eye out for Tax Amnesty “Offers” from the Connecticut Department of Revenue, they may appear to be olive branches, but they could have some hidden thorns. Enjoy your September. Federal Personal Income Tax – Treasury and IRS Announce That All Legal Same-Sex Marriages Will Be Recognized For Federal Tax Purposes The U.S. Department of the Treasury and the Internal Revenue Service (IRS) recently ruled that same-sex couples, legally married in jurisdictions that recognize their marriages, will be treated as married for federal tax purposes. As the seasons change so do the mind of the Fiefdoms. The New Jersey tax court has recently decided to change its mind on the proper nexus standard for its now defunct throwout rule, albeit three years after it ceased to be in existence. This position may result in some material refund opportunities for taxpayers. While up in New England, Massachusetts has been quite busy becoming Taxachusetts again; but in an odd turn of events, things have taken a significant right turn recently. In July of this year, a new law was passed to impose sales tax on most “computer services” in the state. The taxation of these services was not at all popular. Well I guess some unhappy business owners started throwing computers into the Boston Harbor, exclaiming taxation without representation, or something of that ilk, since Massachusetts has now decided to retroactively repeal this piece of legislation. Hopefully, this will lead to the repeal of a lot of the other unfriendly tax initiatives recently enacted in the Bay State. Have a great rest of your November. Illinois – Corporate Income Tax – Insurance Company Not Required in Combined Group The Illinois Fourth District Appellate Court recently overturned a trial court ruling and determined that a captive insurance company was an insurance company for Illinois corporate income tax purposes, and was therefore not includable in the corporate Illinois combined filing. Under Illinois law, insurance companies cannot be included in a combined return with noninsurance affiliates because insurance companies are required to apportion business income using a different single-factor apportionment formula based on direct premiums written. Although a significant amount of the insurance company’s income for the tax years in question was generated from intercompany trademark royalty payments and interest, rather than from insurance premiums paid by affiliates, it was […]

As the summer kicks off across our fair land, it’s nice to see that the fiefdoms are busy spreading their taxing tentacles into businesses, regardless of Constitutional law. California’s ruling concerning securitization entities once again stretches and contorts the notion of nexus to an unrecognizable degree. I commend them for being so creative and being able to back into the desired result; but I guess when your state needs money to fund pensions, you get these type of “interesting” results. Enjoy your June. California – Corporate Income Tax – Securitization Entities Had Nexus with State Through In-State Agents Special purpose entities (SPEs) created as securitization subsidiaries had substantial nexus with California for corporation franchise and income tax purposes, even though they had no physical presence in California. The SPEs were part of one corporate enterprise that loaned money to buyers of motorcycles, equipment, clothing, insurance, and extended warranties; securitized and bundled thousands of those loans into notes; sold the notes to outside investors; and used the money from the sales of the notes to offer additional loans to buyers of motorcycles, equipment, clothing, insurance and extended warranties. The SPEs did not have a business existence separate and apart from their parent company and its financial subsidiary. The Court held that because the parent company had a right to exercise control over the SPEs, and the SPEs only did business for the financial subsidiary, the SPEs were not third-party independent contractors. Therefore, the SPEs had substantial nexus with the state through their California agents, the parent company, the financial subsidiary, and the various in-state dealerships and, therefore, their California-sourced sales could be included in the sales factor of their combined reporting group for apportionment purposes. Modeling environmental risk factors of autism in mice induces IBD-related gut microbial dysbiosis and hyperserotonemia

Autism spectrum disorder (ASD) is a range of neurodevelopmental conditions that are sharply increasing in prevalence worldwide. Intriguingly, ASD is often accompanied by an array of systemic aberrations including (1) increased serotonin, (2) various modes of gastrointestinal disorders, and (3) inflammatory bowel disease (IBD), albeit the underlying cause for such comorbidities remains uncertain. Also, accumulating number of studies report that the gut microbial composition is significantly altered in children with ASD or patients with IBD. Surprisingly, when we analyzed the gut microbiota of poly I:C and VPA-induced mouse models of ASD, we found a distinct pattern of microbial dysbiosis that highly recapitulated those reported in clinical cases of ASD and IBD. Moreover, we report that such microbial dysbiosis led to notable perturbations in microbial metabolic pathways that are known to negatively affect the host, especially with regards to the pathogenesis of ASD and IBD. Lastly, we found that serum level of serotonin is significantly increased in both poly I:C and VPA mice, and that it correlates with increases of a bacterial genus and a metabolic pathway that are implicated in stimulation of host serotonin production. Our results using animal model identify prenatal environmental risk factors of autism as possible causative agents of IBD-related gut microbial dysbiosis in ASD, and suggest a multifaceted role of gut microbiota in the systemic pathogenesis of ASD and hyperserotonemia.

On the Amazon law front, Maine has now jumped into the deep end of the pool, and the plague just continues to spread. Affordable Care Act – Employer Health Care Mandate Delayed The Obama administration announced a one-year delay in complying with the employer health care mandate. The Affordable Care Act (ACA), required employers with 50 or more employees to offer affordable health insurance to employees or face a $2,000 fine per employee These provisions were supposed to begin in 2014. The administration is expected to publish guidelines describing the transitional rules shortly. Connecticut – All Taxes – Amnesty Program Created; Non-Participation Penalties Apply Connecticut recently passed a law that requires the establishment of a tax amnesty program for persons owing any tax for any taxable period ending on or before November 30, 2012. This tax amnesty program will be conducted during the period from September 16, 2013 to November 15, 2013. If qualifying participants pay their tax and interest due in full on or before November 15, 2013, 75% of the interest due shall be forgiven and any related civil penalties will be waived. As we enter Day 15 of the federal government shutdown, things are getting interesting as the clock is ticking on a possible default. Well, at least the IRS has decided to cease the issuing of liens and levies during this time. This just seems like the right thing to do. While here in the Empire State, our esteemed governor has decided to take away the drivers licenses of taxpayers who owe, according to the state, more than $10,000 in back taxes. Not quite sure how those two are related, but I guess scare tactics are in vogue these days. You have to just love state government. Enjoy the rest of your October. Federal – All Taxes – IRS Ceases Issuing Liens and Levies During Shutdown The Internal Revenue Service is putting the brakes on tax liens and levies during the federal government shutdown. The IRS said in a web posting that it is not sending out levies or liens, either those generated systemically or those manually generated by employees, during the government shutdown. This contradicts a position previously announced by the IRS. http://www.irs.gov/uac/Newsroom/IRS-Operations-During-The-Lapse-In-Appropriations.
