Woman Sues DC Massage Envy for $25M After Alleged Assault

A woman who said she was assaulted at a Massage Envy location in Northwest D.C. filed a $25 million lawsuit on Tuesday against the company and the massage therapist who she said attacked her.

The alleged victim, a married woman in her 20s who is not identified in the suit, said the franchise owners never should have hired the alleged attacker, Habtamu Gebreselassie, 24, and that they knew he previously had been accused of assaulting women. 

"Why not fire him?" asked one of the woman's lawyers, Kim Brooks-Rodney. "Why put him in a position where he can sexually assault someone else?"

Massage Envy's corporate headquarters declined to comment on the suit. They previously said they are looking into whether the franchise owner followed proper procedures after first learning that a customer had accused Gebreselassie of misconduct.

The suit said Gebreselassie removed a sheet that was covering the woman and made inappropriate oral sexual contact toward the end of her 90-minute massage on Sept. 17 at Massage Envy's location in the Tenleytown neighborhood. 

The woman immediately pulled the sheet back up to cover herself and told Gebreselassie to leave. 

"We're done here. We're done here," she repeated, raising her voice. 

The woman was taken to a hospital and given medicine to combat potential sexually transmitted infections. It's not immediately known if she did contract any infections from the attack.

"She still has a long way to go before she finds out whether she contracted one, so obviously, that's distressing to anybody," Brooks-Rodney said. 

Gebreselassie was accused in four reports of sexual misconduct at three different locations: The Massage Envy in Tenleytown, at a Massage Envy in Bowie, Maryland, and at an unaffiliated massage parlor on the 2000 block of P Street NW in D.C.

Three other women said Gebreselassie attacked them in a similar way to what the suit filed Tuesday described. 

The woman who filed the suit is seeking $25 million from Massage Envy, the franchise owners and Gebreselassie. She is represented by Cohen & Cohen, P.C., Kim Brooks Rodney and Adam Leighton.

“She will continue to suffer such pain and suffering for the rest of her life, and she will continue to incur medical, therapeutic, lost wages and related expenses,” the woman’s lawyers said in the suit.

In a news interview and a speech in Pennsylvania, President Donald Trump misleadingly suggested that rising stock value could reduce the national debt. One budget expert told us that notion was “just silly.”

In an interview with Sean Hannity of Fox News, Trump noted that the country’s debt rose by $10 trillion under President Barack Obama and that since he took office, stock values have increased by $5.2 trillion. So, he said, “maybe in a sense we’re reducing debt.”

Trump on Fox News, Oct. 11: The country — we took it over and owed over 20 trillion. As you know the last eight years, they borrowed more than it did in the whole history of our country. So they borrowed more than $10 trillion, right? And yet, we picked up 5.2 trillion just in the stock market. Possibly picked up the whole thing in terms of the first nine months, in terms of value. So you could say, in one sense, we’re really increasing values. And maybe in a sense we’re reducing debt. But we’re very honored by it. And we’re very, very happy with what’s happening on Wall Street.

Trump made similar comments during a speech on tax reform in Harrisburg, Pennsylvania, that same day.

Trump in Harrisburg, Oct. 11: And very proudly, just in the stock market alone, we have increased our economic worth by $5.2 trillion dollars. That’s right since Election Day — $5.2 trillion.

Think about that. That’s a quarter of the $20 trillion that we owe. So we’ve already — but listen to this because we’ve doubled — in the last eight years of the previous administration, the debt doubled, so that in eight years our debt — literally hundreds of years of debt — doubled in eight years to $20 trillion.

But since the election on November 8th, I’ve increased the value of your U.S. assets by more than the $20 trillion that we currently owe. You haven’t heard those numbers.

Trump is right that the federal debt increased under Obama.

Total public debt outstanding rose from $10.6 trillion to $19.9 trillion, an increase of $9.3 trillion. That includes all the money that the government owes to itself, including the Social Security trust funds. Under Obama, the federal debt held by the public grew from $6.3 trillion to $14.4 trillion, an $8.1 trillion increase, or a little more than 128 percent over Obama’s eight years.

The debt continues to rise under Trump. The debt held by the public is now at $14.7 trillion, and the total debt is at $20.4 trillion.

It’s also true that the stock market has been making steady gains.

Since Trump took office, the Dow Jones Industrial Average has climbed 15.9 percent to 22,872 at the close on Oct. 11. Trump takes credit for the rise in the stock market dating back to his election last November — and an argument can be made for a “Trump Rally” that many attribute at least partly to investor optimism that the president-elect would, once in office, cut taxes and regulation as promised. The Standard & Poor’s 500-stock average rose nearly 6 percent between Election Day and Obama’s last day in office.

The White House said Trump arrived at the $5.2 trillion figure by looking at the Wilshire 5000 Total Market Index. (A single point in the Wilshire 5000 represents about $1.15 billion in index market value, and the Wilshire index grew by 4,439 between Nov. 8, 2016, and Oct. 12. That translates to $5.1 trillion growth in market value since Election Day.)

But Trump’s suggestion that stock value somehow reduces the national debt is misleading.

“It’s nonsense,” Marc Goldwein, senior policy director at the Committee for a Responsible Federal Government, told us.

“There is no relationship between the national debt and the value of the stock market, which is the total value of a selection of stocks owned by individuals and being held abroad,” Goldwein said. “It’s just silly. They are totally different economic indicators.”

Those sentiments were echoed by political economist Greg Valliere of Horizon Investments to CNNMoney.

“The stock market’s gains have virtually nothing to do with the size of the national debt, which continues to rise because government spending far exceeds government receipts,” Valliere said. “A higher stock market encourages consumers and companies to spend more, which helps the overall economy. But it’s absurd to contend that the national debt has fallen because of this.”

Indeed, if Trump’s premise were accurate, the debt would have fallen significantly under Obama — because the rise in stock market value didn’t start with Trump’s election.

The S&P 500 index more than doubled — rising by 166 percent — under Obama. The Dow Jones Industrial Average rose 138 percent. And yet, as we said earlier, debt soared under Obama.

The White House referred us to an Oct. 12 interview that White House Legislative Director Marc Short gave to CNN’s Wolf Blitzer.

Short was asked whether a booming stock market would reduce the national debt, as the president suggested. He said it would, because a “booming stock market means that people are continuing to pay more taxes and dividends, so there are additional resources coming in to the Treasury.”

Short added that the country needs to “address its spending habit” but that “the booming stock market does help generate more revenue that can help pay down the debt.”

High stock values can be an indicator of faster economic growth, Goldwein of the Committee for a Responsible Federal Budget told us, but not always.

And higher stock value should translate to moderately higher revenues from capital gains taxes and retirement account withdrawals, he said, but those increased revenues would never be equivalent to the debt. For starters, only 20 to 25 cents of every dollar from capital gains is taxed, Goldwein said. And, it is only taxed when the stocks are sold, not when they are held. So the amount of tax revenue the government gets from that is a tiny fraction of the overall value of stocks.

In its own fact-check of Trump’s comments, the Committee for a Responsible Federal Budget notes: “Last year, capital gains taxes accounted for only 4 percent of total federal revenue – even a record jump in capital gains next year would only reduce further borrowing by about $50 billion, which is less than a tenth of what we are projected to borrow next year.”

And, Goldwein said, those increased revenues are already accounted for in the Congressional Budget Office’s deficit projections.

The CBO reported that the federal government ran a budget deficit of $668 billion in fiscal year 2017, which ended Sept. 30. That was about $25 billion less than the CBO projected in June, “largely because outlays were less than CBO anticipated.”

A CBO analysis of Trump’s proposed budget for fiscal year 2018 estimated that while Trump proposed significant spending cuts, the cumulative deficit over the 2018 to 2027 period would total $6.8 trillion (even as the deficits would decline as a percentage of GDP from 3.6 percent in 2017 to 2.6 percent at the end of the period).

In other words, the debt under Trump’s proposed budget would not be as high as projected under current law, but it would still grow. (We should note that Congress has not yet passed a spending plan for fiscal 2018.)

That Trump budget plan includes $1.9 trillion less in spending on health care in anticipation of a repeal and replace of the Affordable Care Act — which hasn’t happened yet.

The president’s budget also assumes deficit neutral tax reform, which the Trump administration and Republican leaders are not proposing. An analysis by the Committee for a Responsible Federal Budget, for example, concluded the latest iteration of the tax plan would add $2.2 trillion to the debt.

White House budget chief Mick Mulvaney told CNN, “If we simply look at this as being deficit-neutral [tax plan], you’re never going to get the type of tax reform and tax reductions that you need to get to sustain 3 percent economic growth.”

Trump is right that the stock market has been soaring — a trend that began several years ago, but that has been even more pronounced since Trump’s election. But those stock gains are not reducing the ever-growing national debt. At best, the additional tax revenues may contribute to slowing the debt’s growth.

Erich Pearson looked out on blackened tubs of tall marijuana plants that only last week were beginning to be harvested. His crop now either fouled by toxic smoke and ash or scorched completely by the the raging wildfires that have devastated Northern California.

"Unless it’s metal, it’s not here,” said Pearson, the co-founder and CEO of SPARC (San Francisco Patient and Resource Center), while surveying the landscape. “It’s pretty devastating.”

His farm in the Sonoma County town of Glen Ellen produces cannabis for four marijuana dispensaries in San Francisco, Santa Rosa and Sebastopol.

The harvest season was in full swing and many cannabis farmers like Pearson had just began to pick their crops when frenetic winds whipped through Sonoma Valley, charring entire neighborhoods and leveling family farms and vineyards.

Pearson said three homes on the property were destroyed, displacing eight people. Large sprawling barns that the business used for drying cannabis plants burned to the ground, leaving only their tin roofs as evidence of what had stood there.

Plants that didn’t burn entirely were covered in ash — absorbing the thick smoky air that clung to everything.

"With ash and soot and black on it," Pearson said it’s not likely to continue to grow after this."

Hezekiah Allen, executive director of the California Growers Association, said Thursday that at least seven farms had been destroyed, and he expected the number to rise as residents who evacuated the area returned home and surveyed their land.

Grower organizations say the losses to the state’s estimated $21 million cannabis industry are likely to be staggering. Sonoma County alone is home to thousands of grow sites, and the region includes some of the state’s most prominent cannabis operations.

And unlike other agricultural producers affected by the wildfires, cannabis farmers face an even bigger challenge: lack of crop insurance.

"Since hemp is classified as a prohibited substance under federal law, it is not eligible for federal crop insurance," Heather Manzano, acting administrator of the Risk Management Agency, said in a statement. The agency oversees government insurance for farmers.

They also don't have access to traditional banking services, including loans, and operate on a cash basis.

If the area receives any federal aid, marijuana farmers won't have access to that either. The cost to rebuild will be entirely out of pocket. Pearson notes that for a lot of small farmers who've invested their life savings into their business, "it will be all gone."

Pearson said since the fire, he and his crew have spent the majority of their time helping impacted neighbors save pets and livestock.

"Taking care of everything from koi fish to horses," he said.

The California Growers Association, meanwhile, is raising funds through the donations site YouCaring specifically to help growers in California who have been affected by the fire and may have no recourse.

Pearson said his team of workers was beginning to turn its attention back to its own farm, where logs and piles of ash continued to smolder.

While most of the crops were un-salvageable, Pearson said, there was a possibility some could be made into oils. Still, he expected the company would have to lay off at least some of its 22-member workforce.

"You keep going," Pearson said. "And that’s all you can do."

The area around North Korea's nuclear test base may be destabilized after recent tremors and landslides, Reuters reported, and experts say it may not be used for tests much longer.

A small, magnitude 2.7 tremor took place near the Punggye-ri nuclear site, according to South Korea's weather agency, and it did not appear to be man-made, like two others since Pyongyang's powerful Sept. 3 nuclear test. That test was measured with a magnitude of 6.3.

"The explosion from the Sept. 3 test had such power that the existing tunnels within the underground testing site might have caved in," said Kim So-gu, head researcher at the Korea Seismological Institute. "I think the Punggye-ri region is now pretty saturated. If it goes ahead with another test in this area, it could risk radioactive pollution."

The wife and daughter of Aaron Hernandez have dropped their CTE lawsuit against the NFL and the New England Patriots and plan to re-file it Monday in another court.

The "notice of voluntary dismissal without prejudice" was filed Friday in federal court in Boston. The family's lawyers told NBC Boston they are expanding the suit and plan to re-file Monday in Suffolk Superior Court because the issues involved in the complaint are state and not federal in nature.

The lawsuit was filed last month after a brain study showed the former Patriots tight end suffered from a "severe case" of the degenerative brain disease chronic traumatic encephalopathy. Experts said it was the most severe case of CTE they had ever seen in someone his age. The suit claimed the team and the league deprived 4-year-old Avielle Hernandez of the companionship of her father.

The NFL said last month that it would "vigorously" contest the lawsuit, saying it would face "significant legal issues from the start.

League spokesman Joe Lockhart said "any attempt to paint Aaron Hernandez as a victim" is wrong.

Hernandez had Stage 3 out of 4 CTE, usually found in a 67-year-old man. Boston University officials who examined his brain said he also had early brain atrophy and perforations in a central membrane. CTE can be caused by repeated head trauma and leads to symptoms like violent mood swings, depression and other cognitive difficulties.

Hernandez killed himself in April in the jail cell where he was serving a life-without-parole sentence for a 2013 murder. His death came just hours before the Patriots visited the White House to celebrate their latest Super Bowl victory.

Soon after his prison suicide in April, Hernandez's family decided they wanted his brain to be studied by the Boston University Chronic Traumatic Encephalopathy Center.

State officials originally refused to release the brain because it was part of the ongoing investigation into Hernandez's death, but later agreed to release it after his lawyer accused them of holding the brain illegally.

Baez said at the time that the family hoped Hernandez's brain could be examined to help future athletes and to shed any more light on his client's death. A recent study conducted by Boston University found CTE in the brains of 110 of the 111 brains of former NFL players that were tested.

Hernandez, 27, was serving a life sentence for murder and was acquitted in two other killings just days before he hanged himself with a bed sheet attached to his cell window at the Souza-Baranowski Correctional Center in Shirley, Massachusetts, in the early morning hours of April 19.

Hernandez blocked access to his cell from the inside by jamming cardboard into the door tracks, investigators said. They also said there were no signs of a struggle and Hernandez was alone at the time of the hanging.

His Bible was found marked with blood at John 3:16, a verse that describes eternal life for those who believe in God. The verse name was also written in blood on the wall and in pen on his forehead.

A star for the University of Florida when it won the 2008 title, Hernandez dropped to the fourth round of the NFL draft because of trouble in college that included a failed drug test and a bar fight. His name had also come up in an investigation into a shooting.

In three seasons with the Patriots, Hernandez joined Rob Gronkowski to form one of the most potent tight end duos in NFL history. In 2011, his second season, Hernandez caught 79 passes for 910 yards and seven touchdowns to help the team reach the Super Bowl, and he was rewarded with a $40 million contract.

But the Patriots released him in 2013, shortly after he was arrested in the killing of semi-pro football player Odin Lloyd, who was dating the sister of Hernandez's fiancee. Hernandez was convicted and sentenced to life in prison; the conviction was voided because he died before his appeals were exhausted, though that decision is itself being appealed.

Almost 40 percent of American adults are obese, the highest rate ever recorded for the United States, according to a report released Friday by the Centers for Disease Control and Prevention.

Nearly 20 percent of adolescents are obese, also a record high, NBC News reported. That comes out to one in five adolescents aged 12-19. Meanwhile, one in five kids aged 6-11 and one in 10 preschoolers aged 2-5 are obese.

"It's difficult to be optimistic at this point," said Dr. Frank Hu, chair of the Department of Nutrition at the Harvard School of Public Health. "The trend of obesity has been steadily increasing in both children and adults."

Obesity is medically defined as having a body-mass index of more than 30. Overweight and obese children have a higher risk to stay obese and childhood obesity is linked to a higher chance of early death in adulthood.

The Washington Metropolitan Area Transit Authority said they are working to determine how long an attack on a Green Line train went on before their officers responded to the incident.

Robert Bean got on a train at the Navy Yard station that was going toward Branch Avenue. He said a woman sitting right behind him began hitting other passengers.

"The pregnant woman, who was having medical issues, was right here being restrained by another gentleman on the [train], because she continued to repeatedly hit a woman sitting directly in that seat right there facing forward. She just continued to attack her from behind," Bean said.

Bean said he reported the ongoing attack on the intercom to the train operator, but no Metro Transit police officers appeared until about six stops later when the train reached the end of the line.

"When I was about to board the escalator that was when I looked to the employees and I was like, 'We've been on the train for a half an hour now with this person having medical issues, insulting passengers, like, somebody should have really done something about it.And his response was, I should have been more of a man and done something about it myself," he said.

Bean said he felt insulted and embarassed by the employee's comments.

Metro said police stopped the woman and got a warrant for her arrest. Metro did not address the employee's comments to Bean.

"We expect you and we hope that you would, you know, take care of the situation so we can feel safe when we're riding the Metro," rider Jordan Oxmer said of Metro police officers.

Metro said it took police only 10 minutes from when they received the emergency call to arrive at the Branch Avenue station. They are working to determine how long the attack had been going on.

The man accused of killing his pregnant girlfriend, who was a Maryland high school teacher, will not face an additional charge for the death of the fetus, prosecutors announced Friday morning.

Investigators found that the fetus Laura Wallen was carrying was 14 weeks old at the time Wallen was killed, Montgomery County State's Attorney John McCarthy said. Under state law, suspect Tyler Tessier cannot face an additional murder charge for the fetus' death, McCarthy said.

"Based on medical testimony, the child was not viable independent of Ms. Wallen," McCarthy said. "Based on those medical findings and the law of Maryland, as a result, the defendant is not chargeable with a second count of murder related to the child.”

Tessier, 32, was indicted on one count of murder in the death of Wallen, prosecutors said Thursday.

If he is convicted, a judge may take into consideration the fact that Wallen was pregnant. He faces life in prison.

Wallen's family told News4 they will meet with Gov. Larry Hogan soon to request a change to Maryland state law. Their daughter's killer stopped two heartbeats, not one, and he should be charged for that, the family said.

They sent this statement to News4: 

"Our daughter Laura Wallen shared with us that she went to her OBs visit & heard our grandson Reid's heartbeat several weeks before she was murdered, and was overjoyed to have heard & seen Reid's Heart beating as she watched him moving on ultrasound!

Our family will be meeting with the Governor Hogan's office of legislation in the next few weeks to discuss that fact that when Laura was shot in the back of the head, her murder stopped 2 beating hearts- Laura's & Reids. Although we understand the Maryland law, our goal for the future, is to have the legislature examine Fetal Homicide, and revisit neonatal viability (when a fetus can survive, outside the mothers womb) as the parameter for prosecuting a fetal homicide when we know that a fetus's heartbeat is present way before the 23rd to 24th week cut off for when a fetus is considered viable. In many states- 2 heart beats is double murder."

The family said Laura had wanted to name her child Reid.

The group Americans United for Life sent a letter Sept. 28 asking prosecutors to charge Tessier in the fetus' death. The letter suggests Tessier should be charged under the federal law called the Unborn Victims of Violence Act.

"Under the federal law, the age of the baby has no bearing on whether a murder was committed," general counsel Steven H. Aden said. "Here, we know there were two victims: Laura and her unborn baby at 14 weeks, and we're asking for justice for both of those victims."

Maryland criminal defense attorney Richard Finci, who is not connected to the case, said he does not expect the state's attorney to bring federal charges.

"I think Mr. McCarthy runs a very competent, strong office, and he will be able to prosecute a case like this strongly and to the full extent and power of the law. Federal charges, to me, are unlikely," he said.

Wallen, an Olney, Maryland, resident, had been missing for nine days. A search and rescue team found the 31-year-old's body last month in Damascus, Maryland. 

Tessier was arrested hours later and charged with first-degree murder. While she was missing, he spoke at a news conference with Wallen's family, holding his girlfriend's mother's hand. 

Police said Tessier was the father of Wallen's baby and asked Wallen's father for permission to marry her despite being engaged to another woman.

"He has been deceiving and lying their entire existence and their relationship was the only thing that Laura and her family ever fought about," Wallen's father, Mark Wallen, said after a judge ordered Tessier held without bond.

Police said both women knew about their past relationships with Tessier, but both believed he was dating them exclusively. According to charging documents, Wallen sent Tessier's fiancee a text message on Aug. 28 asking if the two could meet. 

"It's important that some things are cleared up and I would imagine that if you were in my position, you'd want some answers as well. By no means is this an attempt at confrontation, just looking for an explanation," the text message read.


She was reported missing a week later. Tessier told police he last saw Wallen alive Sept. 4, but her family said they hadn't seen her since Sept. 1. 

Tessier, of Damascus, pleaded at the news conference for his girlfriend's safe return.

"If somebody has her, please understand that you've taken away a huge person in so many people's life," Tyler Tessier said. "I don't know where she is. I don't know. I pray that she's safe and that she comes back. That's all I care about."

Police had suspected Tessier's "involvement" since the investigation began, and allowed him to speak at the family's news conference as an investigation strategy, Police Chief Tom Manger said.

"He is a monster and he is a liar," Mark Wallen said. "And it was absolutely the hardest thing my wife could do would be to sit next to him and hold his hand." 

Wallen was a beloved social studies teacher at Wilde Lake High School in Columbia, Maryland. Her students and coworkers worried when she failed to show up for the first day of school on Sept. 5.

"She was exemplary," district superintendent Dr. Michael Martirano said. "She led with her heart, care and compassion."

Max Scherzer emerged from the bullpen to protect a lead, and Bryce Harper batted with the bases loaded. Again and again, the Nationals had the defending World Series champions on the ropes. 

For Washington's tortured fans, it was all just another setup for a crushing playoff defeat. 

Scherzer allowed four runs in an exasperating inning of relief, and the Nationals' repeated attempts to rally came up maddeningly short in a 9-8 loss early Friday morning to the Chicago Cubs in Game 5 of their NL Division Series. 

Scherzer called it a "gut punch'' - and a feeling all too familiar. Washington was eliminated in the NLDS for the fourth time in six years, including a trio of Game 5 losses at home. The Nationals haven't won a playoff series since moving to the nation's capital from Montreal in 2005. 

"Here we are in Game 5, play our hearts out, everybody lays it on the line, everybody's fighting to do everything they can and we lose a nail-biter of a game again,'' Scherzer said. "This game's cruel sometimes just the way things can happen. What a series.'' 

This chapter of postseason disappointment may be the wildest yet. There was Jayson Werth whiffing on a line drive to left field, pinch-hitter Adam Lind grounding into a comeback-killing double play and backup catcher Jose Lobaton getting picked off first base to erase another golden chance. 

"It was just a series of bad events,'' manager Dusty Baker said. "It really hurts to lose like that.'' 

Michael A. Taylor had a three-run homer and an RBI single after helping the NL East champions stay alive with a grand slam in Game 4. But the Nationals couldn't overcome a crippling sequence during Chicago's four-run fifth. 

Scherzer entered to a roar from the sellout crowd of 43,989, manager Dusty Baker letting him loose with a 4-3 lead for his first relief appearance since the 2013 playoffs, when he was with the Detroit Tigers. 

Nationals Park rocked as Scherzer got two quick outs, and then it all fell apart. Scherzer allowed three straight hits, the last a two-run double by Addison Russell, and Chicago went ahead 5-4. 

After an intentional walk to Jason Heyward, Scherzer struck out Javier Baez, but catcher Matt Wieters dropped the pitch. The ball rolled away, and then Wieters threw it into right field, allowing Russell to score. 

Baez's bat struck Wieters in the side of the mask on strike three, and the catcher argued unsuccessfully for interference to be called. Major League Baseball rules state that if, in the umpire's judgment, a catcher is struck on a backswing before he secures the ball, it should be called a strike and the play ruled dead. 

Plate umpire Jerry Layne said that because the ball was already past Wieters, Baez's bat did not impede his ability to make a play. 

"The graze of the helmet didn't have anything to do, in my judgment, with anything at all, with that particular play,'' Layne said. 

Wieters was called for catcher's interference on the next at-bat, and then Scherzer plunked Jon Jay to force home a run. 

Wieters called it one of the worst defensive games of his career, and those mistakes cost Scherzer dearly. 

"You can execute pitches and sometimes that's not enough,'' said Scherzer, who was charged with two earned runs. 

Chicago took a 7-4 lead and narrowly staved off Washington's rallies the rest of the way, including a bases-loaded, one-out jam in the seventh when the Nationals got just one run, on Harper's sacrifice fly. 

This elimination-game loss was another stunner a year after a topsy-turvy Game 5 against the Los Angeles Dodgers that included third base coach Bob Henley sending Werth into a sure out at home and ace Clayton Kershaw picking up the save. Scherzer called that "the craziest game'' he had ever been a part of. 

Craziest to that point. Even after Scherzer's 28-pitch maelstrom, the Cubs scored again when Werth slid and missed a line drive in left and got their ninth run in the seventh on an RBI groundout. 

"I can probably count on one hand how many balls I've had go in the lights on me in seven years,'' Werth said, setting his beer bottle down in the locker next to his for perhaps his final media scrum as a National. 

"For that to happen tonight, it feels like if it could go wrong, it did.'' 

The Nationals chipped away and got it to 9-8 in the eighth. Cubs closer Wade Davis stumbled while chasing a seven-out save, but Lind grounded into a double play in the eighth, and then Lobaton was backpicked by Contreras at first base to end a two-on threat. Originally called safe, Lobaton was ruled out after a Cubs challenge when his right foot momentarily slid off the base. 

"I thought I was safe for sure until I saw the replay,'' Lobaton said. "I didn't know that my foot came off.''

Harper said he thought Lobaton was out right away. The 2015 NL MVP got a final chance to keep the season alive, but he went down swinging for the final out. 

"That's what you live for: Go out there and battle your tail off against a great Cubs team and do all the things you could to put your heart and soul into a game,'' Harper said. "Just came up short.'' 

Players said they felt in the dugout like a comeback was inevitable until Harper struck out. It was a familiar, uncomfortable feeling.

"It really felt like it was only a matter of time before one of those breaks, one of those weird plays was going to go our way, we were going to be able to break it open and get over that hump,'' closer Sean Doolittle said. "We just couldn't get it done.''

Preview: Redskins Heavy Favorites Against Vengeful 49ers

The Washington Redskins (2-2) return to action Sunday (1:00 p.m.) at FedEx Field for a Week 6 matchup against the San Francisco 49ers (0-5).

On paper and according to the weekly betting lines, the Redskins have a soft landing spot following their Week 6 bye. In the parity-heavy NFL, there is no such thing. In this case, there is plenty of background drama as well.

Pierre Garcon, Washington’s top receiver last season, faces his former team for the first time since signing a free agent contract with San Francisco this offseason. 49ers rookie head coach and former Redskins offensive coordinator Kyle Shanahan gets a shot at revenge against the team that sent him and his father packing in 2013.

There’s also the never-ending reports that a reunion looms between Shanahan and Kirk Cousins should the Redskins quarterback actually reach free agency next offseason. Sounds like fun.

Here’s a look at four other things to watch in Sunday’s matchup.

Cover Up

The bye week, though earlier than desired, came at a nice time for the Redskins considering the injuries suffered in the 23-20 Week 4 loss at Kansas City on Monday Night Football. The break likely gave left tackle Trent Williams (knee) enough time to recover, though the Pro Bowl is listed as “questionable” after not practicing all week.

Time off wasn’t enough for others. Cornerback Josh Norman (ribs) was ruled out, while starting running back Robert Kelley (ankle) and safety Deshazor Everett (hamstring) are listed as “doubtful” on the weekly injury report.

Quinton Dunbar replaces Norman in the starting lineup and rookie Fabian Moreau will likely receive his most extensive NFL action. Everett’s absence would limit Washington to only three safeties unless another rookie, Fish Smithson, is activated from the practice squad.

There’s no good time for injuries, but in terms of the pass defenders, this isn’t the worst of weeks. San Francisco quarterback Brian Hoyer present something of a challenge in that he’s experienced. He’s also well traveled for a reason. The 49ers entered the week tied for 29th with four touchdown passes and rank 27th with 6.2 yards per attempt average.

Running for Daylight

Running back Chris Thompson has turned into arguably Washington’s top offensive playmaker this season – 7.1 yards per carry, team-high 235 receiving yards. However, the Redskins prefer limiting his workload to 25-30 snaps. That was true even when Kelley missed the Week 3 win over Oakland with a rib injury. That means rookie Samaje Perine (3.1 yards per carry) and Mack Brown will handle early down work with Kelley out.

The 49ers defense allows 366.4 yards per game (28th), but they have forced a league-high six rushing fumbles. Perine has struggled with ball security early this season and won’t have a long leash even without Kelley.

Welcome Back

Despite five productive seasons, the Redskins showed little interest in retaining Garcon this offseason. Perhaps that makes sense long-term, but for now, they miss the physical wide receiver. That’s not just because Garcon ranks eighth in the league with 379 receiving yards on 28 receptions.

The combination of Terrelle Pryor and Josh Doctson hasn’t come close to replacing Garcon’s steady presence. Washington also lost one of its most intense players.

“Yeah, he’s always been angry. [Pierre] was angry at me the whole time he was here,” Redskins coach Jay Gruden joked. “I think that’s what people appreciate about him. When you compete with him or against him, you see the anger that he plays with on tape. It’s not a bad thing. It’s a good thing for a wide receiver.”

Without Norman, the primary coverage duties likely falls to cornerback Bashaud Breeland.

Don’t Sleep on the Underdog

The Las Vegas smart guys installed the Redskins as an 11-point favorite over the 0-5 49ers. Whether that’s fair or not, it’s certainly rare. Washington hasn’t been a double figure favorite since 2009.

The winless start and the point spread hides the fact that San Francisco has lost its last four games by a combined 11 points. There is talent in their defensive front-7 in the form of three recent first round picks: defensive tackle DeForest Buckner, pass rusher Solomon Thomas and inside linebacker Reuben Foster.

Offensively, running back Carlos Hyde (332 yards) ranks among the league-leaders. While Garcon is the primary receiving target, Marquise Goodwin averages an impressive 17.4 yards per catch.

Metro service was suspended between the Smithsonian and Federal Center SW stations Friday morning after someone was struck by a train at L'Enfant Plaza.

Police were called to the station about 9:15 a.m.

Metro said a male was struck by a Blue Line train after an intentional act.

Metro announced later that trains were not running on parts of the Blue, Orange and Silver lines.

Riders were urged to take alternate routes, including walking to different stations or taking buses and shuttles. Shuttle buses arrived at L'Enfant about 40 minutes after the shutdown.

Trains began single-tracking between Smithsonian and Federal Center SW stations Service returned to normal by noon.

Metro urged people to consider alternate routes, which they detailed on the Metrorail Info Twitter page.

Prince George's County police are searching for a 15-year-old girl who hasn't been seen in three days. 

Cortney Freeman was last seen at 3:30 a.m Tuesday on the 6100 block of Westchester Park Drive in College Park. 

Freeman is 5 feet 7 inches tall and weighs 200 pounds. She was last seen wearing a blue hoodie, blue shorts, and gray and orange shoes.

A Virginia man has filed suit against a D.C. massage therapist who he said  sexually assaulted him.

Marrett Ceo said he walked into the Hai Gloss Nail and Beauty Spa in Northwest for a facial and a massage in February 2016.

"I wanted to look younger, healthier," Ceo said. "An innocent day off turned into a nightmare."

Ceo said his masseur, Hai Huynh, put a tea bag over each of his eyes. After that, he said Huynh sexually assaulted him.

Ceo said he then yelled at Huynh to stop, put on his clothes and called police.

"I feel violated, betrayed," Ceo said.

According to court documents, Huynh was charged with first-degree sexual abuse of a patient or client, and he pleaded not guilty.

Ceo has hired attorney Dawn Jackson of Jackson & Associates to file a civil suit against Hai Huynh Enterprises.

"He's not asking that this complaint to be filed under seal. He wants other men, other victims to come forward," Jackson said.

"I'm going to be one victim that is not going to be in the shadows any longer," Ceo said. "It's about coming forward and holding people accountable for their actions."

A trial date is set for Feb. 26, 2018.

An employee of the spa said Huynh was not available. News4 was unable to reach his public defender.

Oakland Couple Pulls Off Wedding Despite North Bay Fires

Rick Grenis and his bride Bonnie Frazier spent the past year or so planning the wedding of their dreams in wine country. Come last weekend, the finishing touches were sealed in place and the enthusiastic couple was settling in for a week of relaxation, counting down the days before their "big day."

But then the wildfires ignited. Raging infernos ripped across the North Bay, leveling homes and forcing thousands of people to flee for their lives. More than two dozen people have perished as a result of the calamitous firestorm.

Hours after the blazes took off out of control, Grenis and Frazier received a phone call. It was their wedding planning company. The owner of the business lost her home to the flames. The couple's primary wedding planner had her home left in a heap of smoldering rubble.

The stream of unfortunate news wasn't over. The couple later learned that their coveted venue near Healdsburg was closed indefinitely due to the imminent danger presented by the unpredictable blazes.

"We were pretty distraught," Grenis said. "We didn’t know what to do. We didn’t know the status of anything. We were in shock."

Monday — the day after the fires started — was filled with devastation and mourning for the nearly newlyweds. A year of planning had been wiped away in a matter of hours.

But the ferocity of the flames, thickness of smoke and overall feelings of despair were not going to stop them from saying "I do."


"Come Tuesday, we kind of stepped into gear," Grenis said. "Bonnie mourned for about a day and then the rest of the week she just kicked a--. Our apartment became central command."

Grenis and Frazier weren’t alone in their efforts. Family, friends and vendors chipped in however they could to make sure the wedding would go on. Even the wedding planners from the wine country-based company "Run Away With Me" pressed forward.

"Our wedding planners lost their homes and they’re still out there driving around looking at venues for us," Grenis said. "That’s so unbelievable."

Some uneasiness and guilt were admittedly felt by Grenis. Pushing forward with a wedding given the circumstances was hard to stomach at first. Grenis couldn't understand why the wedding planners, given everything they were experiencing, were sticking around to finish the job.

"They said there's not much that they can do now," Grenis said. "This helps them keep their minds off of it, keeps it busy."

"What about all the caterers and all the staff?" Grenis remembers thinking, referring to the other vendors who were almost certainly impacted in some way by the blazes but still vowed to hold up their promises to the couple.

"[The wedding planners] said, 'Look, a lot of them work at businesses that aren't open or are permanently closed. They're really grateful for the work...People are looking for work. They can't go two weeks without work,'" Grenis said.

So the mad dash to wedding night continued, but Grenis and Frazier still didn't have a new venue.

Billy Grenis, Rick Grenis’ brother, was in New York when he found about the circumstances unfolding on the West Coast. He hopped on social media, sending out pleas for help, asking anyone if they had any advice or knew of venues that could accommodate the couple in need.

"It was just unbelievable to see the outreach of friends, families, people I know, people I don’t know on Twitter suggesting ways to help," Billy Grenis said. "People I hadn’t talked to in awhile were texting me suggestions and ideas."


Billy Grenis himself even took a few shots in the dark. He and some friends tweeted at Oracle Arena, the Oakland Coliseum and Levi’s Stadium, wondering if the sports complexes could perhaps open their doors for a wedding in just a matter of days. He was taken aback when he received a response from Levi’s Stadium. That response came with an offer to host. 

"It was really amazing that they, on such short notice, put me in contact with their event planning team and said, 'Normally we plan these things in advance, but given the situation, we want to help out in anyway we can,'" Billy Grenis said.

The offer on the table from Levi's Stadium came just as Billy Grenis boarded a flight from the East Coast to the Bay Area. When he arrived, he learned that his brother and soon-to-be sister-and-law had also come across another potential break.

Pulling off a wedding at Levi’s Stadium in such a short amount of time eventually wouldn’t pan out, but a location in Marin County — much more suitable for the couple’s wine country wedding wishes — was discovered.

The venue in Novato agreed to host the ceremony despite the short-term notice and granted permission to the couple to bring in outside vendors, even though that’s not usually allowed. The venue was finalized on Thursday. Over the course of the next several hours, offers of assistance continued to flow.

Restaurants in San Francisco waived late and large group fees so that the wedding guests could be fed. Vendors such as chefs and musicians, who had been gearing up to serve and entertain at the Healdsburg venue, graciously agreed to move to the new wedding location. The wedding planners found a local florist up for the eleventh hour job. A guest from New York even got his hands on face masks and transported them across the country to make sure everyone would be protected from the smoke choking Northern California.

"I told Bonnie, I said, 'At least it’s white. It matches your gown," Rick Grenis said before the wedding. "Trying to find a little bit of humor in this situation."

A jam-packed week full of nearly every emotion possible came to its magical end Friday evening. Rick Grenis and Frazier tied the knot surrounded by their closest family and friends. The wedding planners who had everything stripped away from them days before were right there at the venue to make sure everything ran smoothly.

The couple's wedding didn’t necessarily pan out as they had hoped. But, as Grenis said, what did end up transpiring reminded them that not everything in life goes as planned and that sometimes people just have to "roll with the punches," a motto that they went back to throughout the chaotic week.

"What makes a wedding great isn’t the small details and all the different activities," he said. "It’s the people who are there and the energy they bring. It’s not about how much money or how perfectly everything went, but how well everyone takes it."

Billy Grenis applauded his brother and his newest family member for "just the composure that they held" throughout the ordeal. The couple's resolve and an all-hands-on-deck effort turned a nightmarish situation into a moment in time that those involved will likely never forget.

"It’s just amazing to see that despite many bad things happening in this situation and others, there’s just so many good people out there, people that are willing to help and make this day special," Billy Grenis said.

A California couple survived the deadly wildfire raging around them by taking shelter in their neighbors' swimming pool, the Los Angeles Times reported.

Jan Pascoe, 65, and John Pascoe, 70, tried to flee their home in the hills above the city of Santa Rosa late Sunday as flames from one of 21 wildfires burning across the state closed in.

The Pascoes, trapped on the mountaintop, remembered their neighbors' pool and made the decision to take shelter in the "blackened, debris-filled" water. The retired couple told the Times they held each other for warmth in the cold water as houses burned down all around them and the flames inched closer.

"The heat was 'whoa'" John said.

In order to protect themselves from the smoke and embers, the Pascoes told the Times they held T-shirts over their faces while bobbing in and out of the water.

"I just kept going under," Jan explained. "And I kept saying, 'How long does it take for a house to burn down?'"

Meanwhile the couple’s two daughters endured several agonizing hours after losing contact with their parents Sunday night, shortly after calling to urge them to evacuate.

The pair said they first smelled smoke around 10 p.m. PT Sunday, when, according to Jan's phone, the fire was still 11 miles away and they had not received any official alerts informing residents about evacuations in their area.

They were awakened at midnight by a call from their older daughter, Zoe Giraudo, who urged them to "get out," and by then the wind had picked up and the flames were lurking outside.

They got in their cars, drove down their long driveway and were met with a "wall of flames," Jan told the Times.

They had called 911 before going in the pool and throughout the night, Jan thought someone would "come to get us." But no one came.

When they finally were able to get out six hours later, Jan told the Times the cellphone she left at the pool's edge had melted and everything around them was completely destroyed, including their home.

Sonoma County’s Emergency Manager Christopher Helgren is facing criticism over his decision not to activate the county’s wireless emergency alert system as the deadly Tubbs Fire grew.

Helgren told NBC Bay Area Investigative Unit that sending out a countywide alert to 500,000 residents would have done more harm than good because the area covered by such an alarm can't be restricted and far more people would have been alerted than were actually in harm's way, causing traffic jams and hampering emergency efforts.

Instead, Sonoma County used the Soco Alert system to send a robocall to 170,000 landlines and 15,000 residents who signed up to receive notifications through the system.

The series of fires in Northern California have destroyed 3,500 structures, and together make the deadliest week of wildfires in California history.

An 8-year-old girl suffered fatal injuries Saturday after falling two stories from a cruise ship at PortMiami Saturday, Miami-Dade Police Department said.

During the debarkation process on board the Carnival Glory at around 8:15 a.m., the girl fell from a balcony in the ship’s interior atrium to the lower deck.

Carnival Cruise Line released the following statement regarding the incident:

"The ship's medical team responded immediately and the child was transported to the ship's medical center. She was subsequently transferred via ambulance to a local hospital. The ship's command immediately contacted Miami-Dade Police Department which is on site. Our most heartfelt care and concern is with the family at this very difficult time."

The girl was transported to Ryder Trauma Center in extremely critical condition where she later died, according to Miami Fire-Rescue.

Police: Man Shot Stranger in Face Inside Maryland Walmart

A man has been arrested after police say he shot a stranger in the face inside a Walmart store in Maryland. 

De’Andre Edward Eason, 20, has been charged with shooting and wounding a man inside the Walmart store on the 3200 block of North Ridge Road in Ellicott City, Howard County police said Friday. 

Police were called to the store about midnight Sunday, Oct. 8 for a report of a fight inside the store with shots fired. 

Officers arrived and found a 23-year-old man with a non-fatal gunshot wound to the side of his face.

Detectives believe the men "exchanged words and gestures as they passed, the context of which is unknown." The man was leaving the store and Eason was entering.

The man turned around and walked back into the store to confront Eason, police said. Eason pulled out his gun, shot at the man and then fled the Walmart store, police said. 

Police previously said that the shooting victim then went to a vehicle in the parking lot and fired "multiple retaliatory shots" toward the store. No one was hit by that second volley of gunfire.

The shooting victim was taken to a hospital and later released.

There is no indication that the men knew each other, police said. The investigation is ongoing.

Eason has been charged with first-degree attempted murder, assault and handgun violations.

Tina Frost, a victim from the Las Vegas concert shooting, continues to make progress after being seriously injured by gunfire, according to a GoFundMe page statement.

Stephen Paddock, 64, of Mesquite, Nevada, opened fire from his 32nd floor of a nearby hotel onto a crowd of people attending a concert on the Las Vegas strip on Oct. 1. Fifty eight people were killed, and more than 500 people were injured, including Frost, who grew up in Anne Arundel County, Maryland.

Frost was shot in the head but survived. Her family said the bullet lodged in her right eye, and doctors had to remove the eye. She was originally in a coma but has been making progress, including waking up on her own and responding to people and music.

A statement on her GoFundMe page said Frost took her first steps on Friday, Oct. 13 with the assistance of nurses. It said doctors still expect a long road to recovery and with more surgeries.

The statement said Frost is tapping to music and squeezing the hands of visitors. It said she was able to breathe on her own for six hours.

The man accused of killing a Muslim teenage girl as she headed to a mosque in Virginia during Ramadan appeared in court Friday, and her devastated parents interrupted court proceedings. 

"You killed my daughter!" Nabra Hassanen's father shouted. He stood on a courtroom bench and lunged at the accused, Darwin Martinez Torres, in a packed courtroom Friday afternoon. 

Hassanen's mother hurled a shoe at Torres from across the courtroom and screamed "I kill you!"

Torres did not react.

Deputies rushed into the packed courtroom to maintain order. The judge and Torres were immediately escorted out of the room for their safety. Other people, who shouted curse words at Torres, also were led out. Deputies pulled Hassanen's father out of the courtroom as he shouted.

After the outburst, Ray Morrogh, the Fairfax County Commonwealth's Attorney, said he sympathized with the Hassanens.

"I just feel for those people. They're so nice. They're so nice," Morrogh said, shaking his head.

After the uproar, Tores waived his right to a preliminary hearing.

Hassanen, who was 17, was beaten to death on June 18 as she returning to the All Dulles Area Muslim Society mosque in Sterling, Virginia.

Torres was charged with murder but not a hate crime. Prosecutors say he lashed out in a case of road rage. 

The case drew national attention, #JusticeforNabra was used internationally and vigils for Hassanen were held across the country.

Hassanen's father, Mohmod Hassanen, briefly spoke outside the courthouse, where at least 100 people chanted "Justice for Nabra."

“Every day, I think about my daughter," he said.

“She think about other people, but today she's not with me. I lose her. But we say Alhamdulillah," Hassanen continued, using the Arabic expression for "Thanks be to God."

"Alhamdulillah," the crowd echoed.

"Alhamdulillah," Hassanen repeated, to the crowd's echo again.

People assembled outside the courthouse -- many of them teenagers -- held posters with photos and drawings of Hassanen on them. In some of the drawings, Hassanen wears a hijab with the American flag printed on it. 

The night Hassanen was killed, she was walking in a group of about 15 teenagers during a break from Ramadan prayers. A driver approached them and began arguing with one of the boys in the group, police said.

Torres chased the group in his car and drove onto a curb, police said. He got out of the car with a baseball bat and hit Hassanen with it, police said.

Then, he drove away with her in his car, attacked her again and dumped her body in a pond in Loudoun County.

Earlier this year, about 5,000 mourners attended Hassanen's funeral, where people spoke about her kindness and openness. 

Hassanen's younger sister, Noor, attended a vigil that night.

"I just want to thank everybody for your love and support, and I just want to say to Nabra, I love you and I will always miss you," she said.

It’s 2 p.m. on a Friday. You’re at your desk. Things are slow. 

Then you look out your office window, across K Street and glimpse a redhead with big, blue eyes gazing back at you. Wait. Is that a clown??

When the law offices of Arnold & Porter moved into new offices on the 600 block of Massachusetts Avenue NW, they quickly discovered their neighbors were complete clowns.

For three years, a faded clown had sat at an empty desk in the Association of American Medical Colleges' office after one employee was transferred to New York.

“We missed his presence, so we put a clown here in his place,” said Hannah Kittel, who works for the association.

The clown lived a peaceful existence until 600 lawyers moved into offices across the street.

That’s when things got competitive. The lawyers bought their own clown and put him in the window.

Kittel and her coworkers soon noticed this new clown on the block, and accepted the challenge.

“We looked on Amazon and bought five more,” Kittel said.

The lawyers weren’t going to be outdone by a nonprofit, though.

“So we put up about 20 clowns,” attorney Allison Rumsey said.

“Then things kinda got serious,” Kittel said. “We needed to maintain our clown dominance on the block.”

So, the fight escalated. More clowns moved into the neighborhood, and then the lawyers started posting messages to the office across the street. 

The first message: “We come in peace.”

The association then created a masterpiece of sticky note art. The notes said "Yes" and "Time? Place?" 

Soon enough, the lawyers, through big signs in the window, asked their neighbors if they wanted to get together. They posted the time, Friday, Oct. 13 after work, and invited them to their rooftop.

Kittel showed up to work Friday ready to go, complete with a wig and a big red nose.
